AP: Penn St. to bring in victim fund vet Feinberg

HARRISBURG, Pa. (AP) ? Penn State plans to bring in the man who ran the Sept. 11 victim fund and other major compensation programs to help it settle claims by Jerry Sandusky's child molestation victims, a plaintiffs' lawyer said Thursday.

St. Paul, Minn., attorney Jeff Anderson said a lawyer for the university notified him in recent days that the school will be aided by lawyer Ken Feinberg.

"Any action toward bringing resolution and transparency is better than no action, and actions speak louder than words," Anderson said.

Feinberg and university spokesman Dave La Torre both declined to comment.

Lawyers for Sandusky's victims and other potential claimants had complained recently that the school had not followed up on its pledge to settle the civil claims quickly and fairly. Attorneys told The Associated Press this month that they had very limited contact with the university and, if that continued, more lawsuits were expected.

Philadelphia lawyer Joel Feller, part of a team that represents four of the 10 victims in Sandusky's criminal case, as well as Sandusky's adopted son Matt Sandusky and other claimants, confirmed he also was contacted by Penn State about Feinberg's participation.

Feller said he was waiting to learn more about how the school plans to proceed.

"Whether this is a positive or negative step will be determined solely by Penn State taking responsibility for the compensatory and punitive damages owed to these young men," Feller said.

It's unclear precisely what role Feinberg and his firm will play, what compensation they might be getting or whether Penn State has made critical decisions about how much money to offer, where it will come from, how victims will be evaluated and the mechanism for making payments.

Feinberg also ran victim compensation funds for victims of Agent Orange, the Virginia Tech massacre and the Gulf of Mexico oil spill. He outlined some of the possible approaches for such funds in his new book, "Who Gets What: Fair Compensation after Tragedy and Financial Upheaval," which details the processes he's used.

He writes that more than $7 billion in taxpayer money was used to pay survivors of the 2001 terror attacks, with an average award for death about $2 million, for injury about $400,000. Ninety-eight percent of claimants participated, and just 94 families opted out so they could sue.

After the Virginia Tech shooting, $6.5 million was distributed among 32 families, including five faculty members, using a methodology that took into account the length of hospital stays for those who survived.

The BP spill led to establishment of the Gulf Coast Claims Facility, which as of March had paid more than $6 billion to some 169,000 claimants.

Sandusky, 68, is scheduled to be sentenced next month on 45 child sexual abuse counts. Given his age, the number of charges and serious nature of the crimes, he will likely receive a state prison term that will keep in behind bars for the rest of his life.

Bermuda's red soils blew in from Africa

Bermuda is known for its white sand beaches and its stunning red soils, called "terra rossa." But the origin of this red earth has been a bone of contention among geologists. How did it get there?

A new study suggests that much of it blew in all the way from Africa, accumulating little by little over the last 1 million years or so. In the study, published Sept. 1 in the Journal of Geophysical Research, scientists found that the chemical makeup of Bermuda's red soils closely matched that of clay-rich dust blown out of Africa.

The dust comes from the Sahara and the Sahel regions of northern Africa. It's blown to Bermuda by westerly winds, a process enhanced by hurricanes and tropical storms. Some research has suggested that this dust can actually disrupt hurricane formation, though scientists are still studying this potential effect.

The origin of Bermuda's clay-filled, iron-rich soils has been something of a mystery, since the white sand dunes and beaches of the island don't contain the minerals necessary for forming red earth, said co-author Daniel Muhs, a researcher at the U.S. Geological Survey. Bermuda's white sands are made of calcium carbonate and derived from eons-old corals and shellfish, Muhs told OurAmazingPlanet.

That left two possible origins for terra rossa: Either it formed from the breakdown of volcanic rock buried beneath sand dunes, or it blew in from elsewhere, likely Africa.

The study found, for the first time, that wind carrying African dust did make it as far north as Bermuda, which is at the same latitude as South Carolina. It also found that some of Bermuda's red soil is formed from the breakdown of volcanic rocks, but that this doesn't account for all of the island's earth. ?

Over time, this yearly peppering of dust has enriched soils in Florida, Bermuda and elsewhere in the Caribbean, without which the soil in these areas would be much poorer.

"There aren't many plants that can grow in calcium carbonate," Muhs said. "For plants to grow, you need clays, which are reservoirs of soil nutrients, in this case blown in by the wind."??

Russia accuses USAID of trying to sway elections

MOSCOW (AP) ? Russia on Wednesday explained its decision to put an end to the U.S. Agency for International Development's two decades of work in Russia by saying the U.S. government agency was using its money to influence elections.

The U.S. State Department announced Tuesday that Russia has demanded USAID leave the country, a culmination of years of resentment over what Moscow sees as American interference aimed at undermining President Vladimir Putin's hold on power.

"We are talking about attempts through the issuing of grants to affect the course of political processes, including elections on various levels, and institutions of civil society," Foreign Ministry spokesman Alexander Lukashevich said.

Nearly 60 percent of the aid agency's $50 million annual budget this year has been allocated for the promotion of democracy and civil society in Russia. Some of this money has gone to support Russia's only independent election monitoring group, Golos, which fielded thousands of observers in last winter's parliamentary and presidential elections, and compiled reports of widespread vote fraud in support of Putin's party.

Putin had accused Western governments of trying to influence the December parliamentary vote through their grant recipients, and a state-owned television channel directly denounced Golos, showing suitcases full of dollars that the group supposedly had received. After those elections set off an unprecedented wave of protests, Putin accused the demonstrators of being in the pay of Washington.

"All of this is part of a series of moves aimed at toughening policy toward protests, the Internet, NGOs and freedom of speech," said Grigory Melkonyants, the deputy director of Golos. "The people who make these decisions intend to crack down on dissent and criticism in a way that is as harsh as possible. It is frightening even to think about what may happen tomorrow."

Since Putin returned to the presidency in May, the Kremlin has taken a tougher stance against the opposition and Russia's nascent civil society. Non-governmental organizations that receive foreign funding and engage in vaguely defined political activity must now register as "foreign agents," a requirement that is intended to destroy their credibility among Russians.

But few sources of funding are available within Russia for organizations whose work, even if not directly political, can be seen as providing a check on the government. The Moscow office of Transparency International and two of Russia's oldest and most respected human rights organizations, Memorial and the Moscow Helsinki Group, are among those that have come to depend on foreign money. It is unclear how these groups will survive.

Arseny Roginsky, who heads Memorial, said his group will revert to Soviet times and rely on the work of volunteers.

More than a third of USAID funding, however, has gone toward programs in health and the environment, which generally have been welcomed by the Russian government.

State Department spokeswoman Victoria Nuland expressed the hope Tuesday that the Russian government will now assume responsibility for all of USAID's initiatives.

The Foreign Ministry has imposed an Oct. 1 deadline for the aid agency to end its activities in Russia, but U.S. officials have said they will wind down its programs in an orderly fashion. They also have made clear they are scrambling to find new ways of getting money to the Russian organizations that have received USAID funds, potentially setting up a further showdown with the Kremlin.
